You May Be Eligible to Receive Compensation
Lawsuits are being filed against hernia mesh manufacturers across the United States for complications that occur during surgery or in the recovery period, post-surgery. Complications may include adhesions, obstructions and/or migration, often requiring additional surgery to repair the problem.
Injuries and side effects
With or without surgery, hernias have a high rate of recurrence. In an attempt to help strengthen the muscle and reduce the recurrence rate, surgeons frequently use hernia mesh in the incisional repair procedure. Among the most common complications following a surgical repair of a hernia with a defective mesh are:
– Infection
– Recurrence
– Adhesion (Scar-like tissue that sticks together)
– Migration
– Shrinkage
The Litigation
There are many types of hernia mesh and several different manufacturers. For some of the manufacturers, multi-district litigations (MDLs) have been formed so that similar cases can be filed in one court before one judge. This is a much more efficient process for all parties.
The lawsuits against Atrium Medical Corp. (C-Qur Mesh Products Liability Litigation) have been consolidated in the United States District Court of the District of New Hampshire before Judge Landya B. McCaffetry – U.S. District Court in Concord, NH.
The lawsuits against Davol, Inc./C.R. Bard, Inc., (Polypropylene Hernia Mesh Products Liability Litigation): Consolidated in the United States District Court of the Southern District of Ohio before Judge Edmund A. Sargus – US Courthouse in Columbus, OH
At this time, consolidation of Covidien Hernia Mesh cases has been deemed premature with opposition from plaintiffs stating it could affect the discovery of active litigations. As the number of cases filed against Covidien rises, it is expected that the JPML will re-evaluate their position to consider a MDL.
The lawsuits against Johnson & Johnson; Ethicon Physiomesh (Flexible Composite Hernia Mesh Products Liability Litigation): Consolidated in the United States District Court Northern District of Georgia before Judge Richard W. Story – United States Courthouse in Atlanta, GA.
Hernia Treatments: “Watchful Waiting”, Surgical Mesh, Sutures (stitches)
The FDA recommends different treatment options for hernias. The non-surgical option is a Watchful-Waiting method that a surgeon may elect to do. The surgeon will watch for any indications of the hernia increasing in size or if any complications arise.
While surgery is the only way to repair a hernia, surgeons have a few options based on the hernia location and size. A laparoscopic surgery is a less-invasive option where small incisions are made and tools are used to repair the hernia. The other surgical option would be an open procedure where the doctor may choose to use a mesh or sutures. The suture approach can also be referred to as primary closure.
